The Fight for Justice launches a Crowdfunding campaign to support Torina Collis as she continues her 10 year pursuit and awaits the anticipated upcoming U.S. Supreme Court conference for her case on April 24, 2015.
Online, April 23, 2015 (Newswire.com) - According to court records, Case number 06-1346 in the U.S. District Court in Greenbelt, MD, Torina was dismissed from her job as a Senior Personal Banker after uncovering alleged questionable banking practices within the banking giant and bringing it to the attention of senior management. Following her alleged unfair dismissal back in 2005, Torina Collis began a lawsuit against Bank of America under the Sarbanes Oxley Whistleblowing Statute.
Based on statements by the bank and their law firm, the U.S. Department of Labor dismissed the case. Torina brought the case to the US District Court in Greenbelt, Maryland -Case No. 06-1346.
The bank offered to settle the case out of court, but Torina declined. Torina was granted a trial on a separate related case 06-2451 at the U.S. District Court in Greenbelt, MD. After trial, Bank of America and its law firm, McGuire Woods, LLP, filed a motion to enforce an unsigned settlement agreement. The U.S. District Court in Greenbelt, Maryland enforced the agreement on July 19, 2010-Case No. 06-1411.
Torina ultimately filed a Writ of Certiorari to the U.S. Supreme Court, Case No. 11-368, alleging the U.S. District Court in Greenbelt, MD erred in enforcing an unsigned settlement agreement. The Writ of Certiorari was denied.
Torina went back to the U.S. District Court in Greenbelt, MD and filed a Rule 60(b) Motion to Vacate the judgment of the enforced unsigned settlement agreement-Case No. 06-0411. The motion was denied. An appeal was filed in the U.S. Court of Appeals for the Fourth Circuit in Richmond, VA Case No. 11-2100. The appeal was denied.
Torina turned to the Circuit Court of Prince George's County and filed a new lawsuit for conspiracy against Bank of America, three former employees, Bank of America's law firm and the attorney individually. Torina sought a declaratory judgment to nullify the unsigned settlement agreement-Case No. CAL10-34393. The Circuit Court in Maryland dismissed the case.
Torina is seeking review from the highest court in the land as she believes the Circuit court does indeed have jurisdiction to review the alleged agreement as it's governed by Maryland law.
Torina's next Writ of Certiorari to the U.S. Supreme Court is set for conference April 24, 2015 Case number 14-996.
